Terms of Service
Effective 2026-05-17. These Terms govern your use of app.hackersagent.com, api.hackersagent.com, and any other product we operate under the Hackers Agent name (the "Service").
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, do not use the Service.
1. Who can use it
- You must be at least 18 years old.
- You must have authority to use the Service on behalf of any organization you list at sign-up.
- You may not use the Service if you are subject to U.S. export controls (OFAC SDN list, etc.) or if your local law prohibits it.
2. Acceptable use
Hackers Agent is a software platform for authorized defensive security research, vulnerability triage, and threat intelligence by qualified professionals. It is not a hacking tool, a "circumvention device", or a service for attacking systems you do not own. You agree NOT to use the Service to:
- Conduct security testing against systems you do not own or do not have explicit written authorization to test (including bug-bounty programs that require enrollment).
- Develop, distribute, deploy, or assist others in distributing malware, ransomware, spyware, stalkerware, keyloggers, password crackers, or commercial offensive cyber capabilities.
- Engage in mass scanning, denial-of-service, credential stuffing, web scraping at scale, or other abusive automation against targets you do not control or operate.
- Attempt to gain unauthorized access to any account, system, network, or data, or to bypass security, authentication, rate-limit, or DRM controls of any third party.
- Harass, stalk, threaten, defame, or harm any individual, or collect non-public personal data without the data subject's consent or a lawful basis.
- Violate sanctions, export-control, or anti-money-laundering law, or use the Service to facilitate weapons trafficking, child sexual exploitation, human trafficking, or terrorism.
- Engage in fraud, market manipulation, intellectual-property infringement, or any activity that is illegal in your jurisdiction or in the United States.
- Reverse-engineer, scrape, or attempt to extract our agent prompts, proprietary chains, or model weights.
- Resell, sub-license, or white-label the Service without a written agreement.
You represent that any target you submit to the Service is either (a) owned by you, (b) covered by a written authorization you can produce on request, or (c) part of a public vulnerability-disclosure or bug-bounty program whose scope you are operating within.
We may suspend or terminate your account immediately and without refund if we believe (in good faith) you have breached this section. We may report unlawful activity to law enforcement and cooperate with any investigation as required by law.
3. Subscriptions, tokens, and billing
The Service offers Free, Pro, and Max tiers. Token-based metering applies on top of any tier; agents consume tokens per invoke per the table on the Pricing page. Max-tier subscribers may additionally pin individual agents to a specific LLM provider/model from the supported list — see Profile → Custom Agent Models.
Payments are processed by our payment provider (currently Stripe; we may add additional Merchant-of-Record providers such as Paddle with notice). By submitting payment, you authorize us and our payment provider to charge the listed amount to your selected payment method and you accept the Refund & Content Policy below. Sales tax, VAT, and similar transaction taxes may be added at checkout based on your billing address; where Paddle acts as Merchant of Record, Paddle is the seller of record on your receipt.
3.1 Digital nature of the Service
By using the Hackers Agent platform, you acknowledge that our service provides instant access to digital resources and computational power. Due to the high operational costs associated with generating AI content (GPU cycles, frontier LLM API charges, and orchestration overhead), we maintain a strict refund policy to ensure the sustainability of the Service.
3.2 No-refund policy for generated content
Once a "Generation Event" — the creation of text, code, images, reports, or data by an agent — has been initiated at your request, the Service is considered fully rendered and delivered at the moment the agent begins processing.
- Final sale. All charges for successful AI generations are final and non-refundable.
- Subjective satisfaction. Refunds will not be issued based on the perceived “quality” or “accuracy” of the generated output. AI is probabilistic; you assume the risk of the output's utility for your use-case.
- Token / credit usage. Tokens, credits, or top-up packs consumed during a Generation Event are non-reversible. Unused balances do not expire across monthly resets but are non-refundable for cash.
3.3 Subscription cancellations
You may cancel your subscription at any time via Profile → Billing or the Stripe Customer Portal.
- Access. Upon cancellation, you retain access to your tier's features until the end of the current billing cycle.
- No proration. We do not offer prorated refunds for mid-cycle cancellations or for tokens remaining unused at the end of a billing period.
- Pricing changes. We may change pricing with 30 days' notice via email. Your existing paid period is honored at the original price.
3.4 Technical failures
Refunds or credit reinstatements may be considered at the sole discretion of Hackers Agent in the following narrowly-defined cases:
- A documented system error in our infrastructure deducted credits without producing any output (verifiable from our server-side logs that bind every Stripe transaction ID to its agent invocation).
- A documented platform-wide service outage prevented usage of paid features for more than 24 continuous hours.
In both cases, you must contact support@hackersagent.com within 30 days of the incident with the affected timestamps. We will respond within 5 business days.
3.5 Chargebacks and disputes
We strongly encourage you to contact support@hackersagent.com before initiating a dispute with your bank or card issuer. Most billing concerns are resolved within one business day.
- Dispute evidence. When a chargeback is opened, we provide our payment processor (Stripe and/or Paddle) with detailed evidence including generation timestamps, IP addresses, agent invocation IDs, token-usage logs, and the signed Terms-of-Service acceptance record bound to your customer ID. This documentation is generally sufficient to refute fraudulent chargebacks for delivered digital services.
- Account termination. Initiating a chargeback without first contacting our support team may result in the permanent ban of your account and the forfeiture of all stored data, conversation history, and unused token balances.
- Recovery of costs. If a chargeback is decided in our favor, we may charge a processing fee to recover the dispute cost imposed by the payment processor.
4. Your content and our content
- Your content stays yours. You retain all rights to the messages, files, and findings you submit. You grant us a worldwide, non-exclusive license to process them as needed to operate the Service.
- Agent output. Agent responses are generated by third-party large language models we route through (currently Anthropic Claude, Google Gemini, and OpenRouter-aggregated providers — the exact set may change over time). When Max-tier custom agent-model selection is enabled, you may direct your prompts to any of the supported providers; the third-party provider's own terms and acceptable-use policy then apply to that traffic in addition to these Terms. We make no warranty as to accuracy, completeness, or fitness for purpose of any agent output, and recommend independent verification before acting on findings.
- Our brand and code. "Hackers Agent", the logo, and the Service software are our property. You may not use the name or logo to imply endorsement without permission.
5. Disclaimers and liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR US $100 IF YOU PAID NOTHING. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
6. Indemnity
You will defend and indemnify us against any third-party claim arising from (a) your breach of these Terms, (b) your misuse of the Service, or (c) content you submit to the Service.
7. Suspension and termination
- You may terminate your account at any time from Profile. Termination does not refund unused subscription time.
- We may suspend or terminate your account at any time with or without notice if we reasonably believe you have breached these Terms.
8. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, excluding conflicts-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you and we consent to personal jurisdiction there.
9. Changes
We may update these Terms. Material changes will be announced by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
